Terms of Service

These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“you” or “User”) and WeSueU, LLC (“Company,” “we,” “us,” or “our”) governing your access to and use of the GlucorAI application, website, and related services (collectively, the “Service”).

BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

GlucorAI provides software tools and AI-assisted insights for informational and educational purposes. It is not a substitute for professional medical advice, diagnosis or treatment. Always consult your healthcare professional regarding treatment decisions.

THE SERVICE IS PROVIDED FOR INFORMATIONAL, EDUCATIONAL, AND PERSONAL TRACKING PURPOSES ONLY. GLUCORAI IS NOT A MEDICAL DEVICE. THE SERVICE HAS NOT BEEN CLEARED, APPROVED, AUTHORIZED, OR OTHERWISE REVIEWED BY THE U.S. FOOD AND DRUG ADMINISTRATION (“FDA”) OR ANY OTHER REGULATORY AUTHORITY FOR THE DIAGNOSIS, CURE, MITIGATION, TREATMENT, OR PREVENTION OF ANY DISEASE OR CONDITION, INCLUDING DIABETES OR HYPOGLYCEMIA/HYPERGLYCEMIA.

NOTHING IN THE SERVICE CONSTITUTES MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR A SUBSTITUTE FOR PROFESSIONAL CLINICAL JUDGMENT. YOU SHOULD ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTHCARE PROVIDER WITH ANY QUESTIONS REGARDING A MEDICAL CONDITION, THERAPY, INSULIN DOSING, DIET, OR OTHER HEALTH-RELATED MATTERS. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF INFORMATION OBTAINED THROUGH THE SERVICE.

Carbohydrate estimates, portion estimates, glucose displays, forecasts, trend analyses, AI-generated insights, barcode lookups, and related outputs are APPROXIMATIONS ONLY and may be incomplete, inaccurate, delayed, or unsuitable for your circumstances. DO NOT USE THE SERVICE TO CALCULATE OR ADJUST INSULIN, MEDICATION, OR OTHER THERAPY DECISIONS.

IF YOU BELIEVE YOU MAY BE EXPERIENCING A MEDICAL EMERGENCY, CALL EMERGENCY SERVICES (FOR EXAMPLE, 911 IN THE UNITED STATES) IMMEDIATELY. THE SERVICE IS NOT DESIGNED OR INTENDED FOR EMERGENCY USE, CRISIS RESPONSE, OR REAL-TIME CLINICAL MONITORING RELIED UPON FOR PATIENT SAFETY.

The Service may display or process data obtained from third-party sources you choose to connect, including continuous glucose monitoring platforms, Nightscout instances, nutrition databases, and cloud providers. We do not control and are not responsible for the accuracy, availability, security, or legality of third-party systems or the data they provide. Your use of third-party services is subject to their respective terms and privacy policies.

Features of the Service may use artificial intelligence, machine learning, computer vision, and automated estimation techniques. Outputs may include errors, hallucinations, or biased results. LiDAR, camera, barcode, and reference-object helpers, where available, do not create exact nutritional measurements. You are solely responsible for reviewing and confirming any estimates before relying on them for personal recordkeeping.

You agree not to misuse the Service, including by attempting to reverse engineer, disrupt, or gain unauthorized access to systems or data; using the Service in any manner that violates applicable law; or representing the Service as FDA-cleared, clinically validated, or suitable for dosing or treatment decisions.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate access if we reasonably believe these Terms have been violated or if continued use poses risk to users, the Service, or third parties.

The Service, including its software, branding, text, graphics, and other content (excluding User Content and third-party data), is owned by WeSueU, LLC or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA OR ESTIMATES WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WESUEU, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, WE SHALL HAVE NO LIABILITY FOR ANY HEALTH OUTCOMES, ADVERSE EVENTS, DOSING ERRORS, RELIANCE ON GLUCOSE OR CARBOHYDRATE ESTIMATES, AI INSIGHTS, FORECASTS, DELAYED OR MISSING DATA, OR DECISIONS MADE BY YOU OR ANY THIRD PARTY BASED ON THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless WeSueU, LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another.

You acknowledge that diabetes management and metabolic health involve inherent risks and that you voluntarily assume all risk associated with using informational tools such as the Service. You remain solely responsible for your health decisions and for verifying information with qualified professionals and your prescribed medical devices.

We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your jurisdiction require otherwise.
